PCMC:

As per the Pune Mirror report, it has come under the scanner that PCMC while remunerating road-affected individuals, has allegedly committed another scam by distributing plots worth crores of rupees in violation of the Land Acquisition Act.

The Town Planning Department of the PCMC has come under observation following allegations of the Land Acquisition Act.

Issues have been raised over the purported distribution of illegal plots to residents affected by the development of Spine Road passing through Triveni Nagar Chowk in Talwade.

According to established rules, in cases of land acquisition for roads or reserve lands, affected property owners are entitled to double compensation based on the ready reckoner rate of the land.

However, apart from legacy practice, residents impacted by the Spine Road project were allegedly granted plots measuring 1250 square feet each.

The unparalleled move has raised suspicion of potential malfeasance and has led to questions regarding the legality of the compensation distribution process.

PCMC while remunerating road-affected property owners, has allegedly committed another fraud by distributing plots worth crores of rupees in violation of the Land Acquisition Act.

Surprisingly, only 50 to 500 square feet of land from road-affected areas have been procured, yet those affected have reportedly been granted a generous 1250 square foot plot each in Borhadewadi Peth no.11.

Talwade IT Park

Talwade area is known as one of the famous IT parks and industrial estates in PCMC and has a huge amount of crowd daily.

Recently, this area has witnessed a notable increase in traffic congestion, particularly in Talwade, Chikhli, and Triveni Nagar.

To address this issue, the PCMC and traffic administration have been implementing tangible actions.

However, Spine Road at Triveni Nagar Chowk in Talwade has emerged as a major hindrance in these efforts.

The Spine Road begins from Bhakti-Shakti Chowk and extends to Triveni Nagar, which has long been a subject of dispute regarding the rehabilitation of affected citizens.

The issue has been pending for the past few years with houses impacted by the road transitioning from Pradhikaran to PCMC.

Urban Planning Department PCMC

 The Urban Planning Department of the PCMC as the part of development process initiated the acquisition of land by razing affected houses to accommodate the affected individuals.

This ongoing process has resulted in the eviction of some households in Triveni Nagar Chowk.

Approx, 132 road-affected property owners in Triveni Nagar Chowk have been slated for reclamation, there has been vocal demand from the affected citizens to receive substitute housing arrangements amidst the ongoing development endeavors

The PCMC has taken action to address the longstanding issue of reclaiming residents affected by the Spine Road passing through the Triveni Nagar Chowk.

To promote this Pimpri Chinchwad Navnagar Development Authority has assigned plots of land in Peth no.11 totaling 8474.78 square meters for plot number one. 2206.58 square meters for plot number two and 6282.72 square meters for plot number 3.

In exchange for this land, the Urban Planning Department of the PCMC has paid approx. Rs 23 crore to the Pimpri Chinchwad Navnagar Development Authority.

The actual land required for the reclamation of these residents in Peth No.11 of the Authority has already been transferred to the PCMC at a rate of Rs. 9,350 per square meter.

Claiming this plot, the PCMC has undertaken reclamation efforts for those affected by the Spine Road Project.

During this reclamation process for the affected road, the Urban Planning Department of the Municipal Corporation has allegedly infringed the government’s Land Acquisition Act.

An illegal agreement has purposely been imitated between the Navnagar Authority, the Municipal Corporation, and the affected residents, resulting in the allocation of a 1250-square-foot plot on a 90-year rental agreement.

Land Acquisition Act

Under the Land Acquisition Act, when procuring land for reserved areas or roads within the city, the Town Planning Department is compelled to provide compensation equal to twice the value of the ready reckoner area, FSI or TDR.

However, it has been presumed that victims of the Spine Road project in Talwade Triveni Nagar have been allotted plots worth lakhs of rupees in contravention of this legal provision.

53 citizens have lost plots ranging from 24 to 500 square feet, 36 citizens have lost plots measuring 500 to 1000 square feet, and 43 plots measuring 1000 to 2000 square feet have been affected.

In response, the PCMC has directly supplied a 1250 square feet plot to 89 affected property owners in Borhadewadi Sector 11, valued at approx. 40 to 50 lakhs.

This decision marks the primary occurrence in the history of the municipal corporation where plots worth Rs 40 to 50 lakhs have been awarded to road-affected citizens in exchange for their properties.

Builder’s Interest in Road-Affected Sites

107 property owners have signed the agreements out of 132 affected individuals with the municipality’s land record department.

Plots have been allocated to those impacted by the road, under a 99-year agreement that barriers sales of the plots.

However, some of affected property owners have reportedly sold these plots to builders with political leaders at hyperbolized rates.

Many citizens who didn’t want a place were shown red zone notices and their houses were wrecked said Nilesh Chaure, a road-affected citizen of Spine Road.

The Pimpri Chinchwad Municipal Corporation has drawn up its own policy and awarded plots by signing an agreement with the citizens.

Some citizens had 500 square feet of space while some had 2500 square feet of space. However, the total space assigned is 1250 square feet.

The municipal corporation had decided to offer alternative places to the citizens affected by the Spine Road as said by Prasad Gaikwad, Deputy Director of the Urban Planning Department at the Municipal Corporation.

Mr. Prasad further said that in the case of procurement of reserved or road land, twice the ready reckoner rate is paid. However, these plots have been allocated to the Spine Road affected by transferring the authority to the municipal corporation.

This policy was rolled out before I took charge at the Municipal Corporation. According to the policy, plots have been allocated in Sector 11.

Their contract has been managed by the Land Records Department.
